Unless they can pin down the EXACT time of death, all they have is she entered the apartment with him and left without him. The door data doesn't provide any clarity, and though Mary is the best suspect, they have nothing they can use to arrest her for the crime. If Mary doesn't screw up, she should be free to go. (Why did the Duck log me out while I was active on site?)
